OWTDS pressure dosed bed and the unauthorized discharge of untreated wastewater to ground
surface and groundwater continues. In addition, the Department has received complaints
suggesting that other community systems not covered by the Permit may be out of compliance and

Mountaire Farms of Delaware, Inc. is authorized by the State of Delaware Spray
Irrigation Permit (No. 359191-06) to spray irrigate treated poultry processing wastewater and
treated sanitary waste. On April 24, 2021, during construction activities, a pipe connecting the
wastewater treatment facility’s spray irrigation pump house and irrigation pivot was damaged by
a contractor excavating the site. The damage to the effluent pipe caused approximately 15,000
gallons of treated effluent to discharge through a newly installed stormwater pipe and outfall to
Swan Creek. This is a violation of 7 Del. C. Chapter 60, the Regulations, and State of Delaware
Spray Irrigation Operations Permit No. 359191-06.
Upon notification by the contractor of the damaged pipe, Mountaire immediately shut-off
flow in the area to stop the release. Mountaire then notified the Department of the release and
began cleanup activities. Since the release involved fully treated wastewater effluent, minimal
cleanup was necessary. Mountaire then repaired the damaged line and performed sampling as
required by the Department. |
